This is a scandalous and sad story of Florida inmate William Westervelt and his treatment by the Florida Department of Corrections (FDC) for saving an employee’s life. In August 2016, William risked his life, to save the life of Penny Sullivan, a Dade Correctional Institution female prison guard. Penny Sullivan was bruetley attacked by a known violent inmate that was unaccounted for and renaming free in the TCU unit. William Westervelt’s quick thinking and heroic actions in saving the prison guards life were cover-up and totally disregarded. Why? Because FDC took great lengths to cover up this investigation and stop it from leaking out to the news. This act of FDC covering up this incident put Williams safety and life at risk.
2.While in the TCU, God had William in a place where he was able to assist and save the life of female Sgt. Penny Sullivan. Sgt. Sullivan was attacked and strangled by the unaccounted for and roaming free psychotic inmate Fernando Carpio X81705. The guttural sounds of Sgt. Sullivan trying to scream for help were unrecognizable at first but William knew something was not right. They heard something on the other side of the cell wall. They investigated and found Sgt. Sullivan on the ground almost unconscious. William’s quick thinking and the help of his cellmate used physical force to get inmate Carpio X81705 to release his death grip choke hold from around officer Sullivan’s neck. Finally, he was able to free Sgt. Sullivan and bring her to safety. This act was captured on several security video and the audio monitors. The TCU had recently installed many new video and audio cameras due to the recent murder of inmate Daryl Rainy within that unit.
3.William complied and was interviewed by the FDC and the Office of Inspector General(OIG) to include his recorded statement.
William was released from the Therapeutic Care Unit (TCU) to the Dade C.I.
4. William navigated life in general population for a few weeks until word began to spread that he was the snitch who saved the violently attacked officer and cooperated with FDC in the investigation. Even worse, violent inmate Fernando Carpio X81705 who was the violent attacker, had gang ties and put a contract out to kill William. This became a reality that was sanctioned by all the gang heads.
5. The Dade Corrections staff knew of this information. On the morning of 10/16/16, five officers surrounded William and had him pack his property ASAP and escorted him to a waiting van for the immediate emergency transfer to the private GEO prison of South Bay C.l. After arrival at South Bay C.I., William never spoke of the events of Dade C.I. and quietly did time the best he could.
6. William sister read a news article from Kent County Michigan, where inmate Antonio Duane Brown, saved the life of a female guard. The scenario was almost identical to William Westervelt’s experience. In the case of inmate Brown, the judge overturned
his sentence and released Brown for his heroic actions. William has never asked for anything in light of his selfless actions. The actions that had now put his life in jeopardy. Should William not have received some type of acknowledgement and recognition from the FDC? To date, all William has never received any consideration or recognition for his heroic and selfless actions. Not even a thank you from the FDC.
7. William’s sister, contacted Dade C. I. seeking information on the attack of prison guard Penny Sullivan. The warden’s secretary and other departments claimed they had no knowledge
the attack ever happened. At one point it was even stated that because William was receiving mental
health treatment in the TCU “he probably imagined it.”
8. Inspector General and found out that Carrie Ryan, was the new inspector at Dade C.I. The violent
offense was assigned case # 16-15532, at the time of the attack but the investigation was shelved
and never completed. Inspector Ryan assured Victoria that she would complete the investigation and
file the report. While this was taking place, William who had been at South Bay for approximately,
three years would be transferred to Moore Haven C.I., another private prison run by GEO.
9. Investigation #16-15523. Victoria spoke to I.G. Ryan several times and noted I.G. Ryan was frustrated
because she was running into roadblocks. Victoria received the I.G. report several months later, which
was not an easy task. Almost four years later the I.G. report was completed. Upon review, it would be
learned that the multiple security videolaudio recordings of the attack were mysteriously missing.
Several other security violations that made the attack possible were lightly addressed or omitted. In
the end felony charges were recommended for the attacker Fernando Carpio X81705, (see Exhibit A).
10.William’s actions, yet all have been ignored. William made several attempts to address the issue by
utilizing the FDC Inmate Grievance System, sadly, this would be disregarded as well. Mr. James, the
onsite FDC representative at the Moore Haven C.l. would respond to William in writing stating
“contacted the department of corrections and stated there was no evidence anywhere of your claim of
saving an FDC employee.” (See Exhibit B). William and his family have tried all available avenues to
pursue this recognition. When the COVID-19 pandemic hit, everything came to a grinding halt, further
attempts at justice were futile.
11. Further insult to injury happened in February, 2021. As Covid restrictions began to ease, the recreation yard at Moore Haven C.l. was reopened. Shortly after, William was assigned a job as a recreation orderly due to his good standing. On his first day as orderly, a falsified claim was made by the recreation coordinator Ms. Marshall, in an attempt to have him fired. William
was brought to her supervisors office where she claimed William had “Intimidated” another orderly.
William immediately requested that the security video from that area be reviewed with superiors. Upon
review, Ms. Marshall’s allegations were proven false and he returned to work. William could not
understand why Ms. Marshall had contrived this story as he never even met her prior to being taken to
the supervisor’s office.
12. positions and she no longer had control of who was chosen. But more importantly, due to a
relationship she had with another inmate she only wanted certain inmates working. The story of the
orderly that William was accused of intimidating by Marshall was caught lying and she was caught
illegally giving jobs to inmates without following the proper channels.
13. Several weeks later weeks later, GEO employee Ms. Marshall would again attempt to have William fired by way of another falsified claim. This time she sought the help of officer Felton, who worked on the recreation yard.
Officer Felton not only refused to partake in this, but would later pull William aside and tell him of Ms.
Marshall’s attempt. Officer Felton further warned William to beware of Marshall. This incident left
William so shocked that he wrote the inspector a detailed account of this event, again citing the
security video recordings.
14. Unable t have William fired, Geo employee Marshall doubled down and went on to write a false Disciplinary Report (DR) claiming (William) made a “spoken threat’ to her. (Exhibit “C”). She then
enlisted the help of friends in classification and together they crafted a Request for Negative Transfer
claiming Marshall was “in fear for her life” based on the falsified “spoken threat.”

15. A negative transfer sent unruly inmates with documented disciplinary issues t institutions that are designated an s suited to handle they type of inmates. A high percentage being gang members.
16. Upon receiving a Request for Negative Transfer, the request must be examined and the allegations verified.That process was not followed and William was denied of his due process rights. In William’s case he had not had a DR disciplinary issue in over five years and had always received the highest ratings (above satisfactory) on this monthly gain time evaluations.
Furthermore, the last incident that should have been listed was saving the officers life at Dade C.I.
17. Because of Williams exemplary record and the fact that their request was not accompanied with a DR and a guilty finding, the Request for Negative Transfer was denied. But instead it was recommended that they re-file for a non-negative transfer. Which if approved would send William to a regular institution. This did not sit well with the group and they continued to plot against William.
18. Shortly after the “spoken threat” DR Hearing took place and based on get investigative findings William was found NOT GUILTY. The following actions that would be carried out by several of the rogue group can only be described as cruel, evil, and possibly criminal. (Exhibit “D”).
19. It has been learned that know the NOT GUILTY finding would put a stop to their further plotting, immediately after the NOT GUILTY verdict was rendered they contacted Moore Haven Warden Loretta Şink and other upper level administration. At which point they intentionally fed them false information claiming”The team found him GUILTY of the DR and he was given time served in confinement and received loss of gain-time) (Exhibit “E”).
20. After all had been hoodwinked, they would again file a Request for Negative Transfer, outrageously submitting the same falsified information. Only this time other was an actual NOT GUILTY FINDING debunking this. B
they were somehow able to circumvent Region 4 and file this one with State Classification in
Tallahassee. Which was assigned to State Classification Officer Williams. The Geo employee Marshall and a small hand full of others were able to follow through with Geo Employee Marshalls plan to transfer William so her unprofessional behaviors which were downright illegal and that did not reflect GEO’s employee professionalism standards would not be questioned. Her job and behaviors were safe.
21. William was free to roam the compound and attend his classes etc. for weeks! If William was such a threat then why was he able to roam free without restrictions? Some how some way Central office would approve the negative transfer and William would be transferred to Hamilton C.I. transferred to Hamilton C.l. Hamilton is not a private facility, and William knew he was again in a FDC managed facility. There are over 140 prisons in the State of Florida, and anyone that has been incarcerated for long will know someone on every compound to which they are assigned. Recognition by other inmates is inevitable. Upon arrival at Hamilton, William was sent to his assigned dorm. In the first sixty minutes, William was recognized by several inmates. In fact, he even knew his cell-mate from a previous camp several years prior. William was approached by two inmates who knew about
his saving the officer at Dade C.I. It was also made known that statewide, multi-gang contract on his life was still very much active. William was told: “you know what’s coming.” In fear for his life, William immediately went to staff and explained the situation. He was then placed in confinement for his protection.
22. William had alway believed that be cause of the death threats at Dade for saving an officer’s life and his emergency transfer to a private prison, that FDC staff, both uniformed and civilian, were aware of his heroic effort and the subsequent protection needs. Unfortunately, that was not the reality in which William found himself. While in confinement, and investigation was initiated to verify William’s claims. It was then discovered that there was neither a record of William saving the officer’s
life at Dade C.I ., nor his need for additional protection. But, thankfully William had a copy of the Criminal investigation Report # 16-15532 and his claim, that some in the department so desperately tried to cover-up, was verified.
HOW COULD AND WHY DID SOMETHING THIS OUTRAGEOUS HAPPEN?23. At the time of the attack in August of 2016, Dade Correctional Institution was dealing with
numerous state and federal investigations involving administrative and security violations. The most
horrific of the incidents investigated was the brutal murder (and cover-up), of innmate Darryl Rainey
who was assigned to the Dade C.I. Therapeutic Care Unit (TCU). Rainey was murdered in the same
TCU that William saved Officer Penny Sullivan’s life. Julie Brown, a reporter for the Miami Herald,
wrote extensively about Rainey’s murder and Dade C.l.’s attempted cover-up.
24. As a direct result of the light shined on this incident by Julie Brown, the fDC reached a settlement agreement with the family of Darryl Rainey. The Department paid the family five million dollars, and to insure that an atrocity like Darryl Rainey’s brutal murder never happened again, FDC made long overdue security upgrades to the Dade C.I. TCU. After suffering such a recent and very public black-eye. 25. The last thing officials at Dade C.l. wanted or needed was news of an attack on aguard by a rouge unaccounted for inmate to become widely known by the public. So, William was almost immediately transferred to South Bay C.I. (a private facility). Once William was gone, Dade C.l. the FDC officials began the work of quietly sweeping the entire incident under the rug, and as we now know, keeping the FDC Central Office officials in the dark.
26. Since it was discovered and brought to the light by the staff at Hamilton C.I. FDC quietly acknowledged these events. On May 23, 2021 William was emergency transferred to Wakulla C.l. Annex and placed in one of their Protective Management Units.
27.l Inmates assigned to a PMU are confined to a single dormitory. They are given an occasional hour of
outdoor recreation; they are not allowed to interact with other inmates outside their dormitory; they are
not allowed assignment to any of the jobs normally filled by inmates; their visitation time is limited to
one hour when the visiting park is open (whereas other inmates have six hours per on visiting days);
other than emergencies, they are only seen at medical, including sick-call, once a week in the
morning; and the list goes on and on it is a truly sad existence; especially for someone that saved an
FDC officer’s life.
28. If someone saved a life of an officer, corrections or otherwise, there would be a ceremony and positive acknowledgements. and the hero would be given a medal.
It appears since the family has made contact with Sgt. Sullivan several months ago and she has publicly written a letter and made phone call and sent emails to top FDC officials verifying the incident and showing her deep gratitude for Williams heroic actions that day she was attacked, William’s life has been a series of falsified DR’s dragging him from a safe space in Moore Haven where he was not guilty of a contrived incident but somehow a negative transfer was added to his folder although still unsubstantiated as FDC/Moore Haven refuses to release documents asked for in a FS 119 request pertaining to the very questionable event.
There is a retaliation against Willam for resurrecting the attack at Dade on Sgt. Sullivan. Why? because the videos depicting this event were almost immediately deleted. Is FDC concerned that Sgt. has since learned of the IG report, the videos missing, and so many untruths in the IG report. Are they afraid of a law suit?
William has only 2years left on the sentence. There are several options available for the FDC to implement in appreciation for William’s saving the life of this FDC employee.
Due to the unusually high amount of trauma Wiliam has experienced and the length of his
incarceration, a transition program is desperately needed, and in Wlliam’s case, warrarnted. William,along with his family, have and will continue to, advocate(d) to the decision makers within the FDC, for
the Bridges Transition program for William’s betterment and reintegration into society. William and his
family both hope and pray that FDC officials will not turn a deaf ear or a blind eye to this plea for
William to be able to serve the rest of his time in a positive and safe environment that will prepare him
for his upcoming return to society. Is this too much to ask? If you asked Penny Sullivan, I bet she
would say it isn’t. In fact the family has since contacted Officer Sullivan. She has stated that she would
willingly attend or speak at any hearing in appreciation of William’s coming to her rescue and saving
her life.
